LAW-8077 Mob Rule: When People Take to the Streets to Create Laws through Ballot Initiatives
A record number of ballot initiatives have been filed with the Attorney General’s office with most making it through the initial vetting of the Attorney General. The topics range from abortion, taxes, repealing legal marijuana, same day voting, rent control, zoning reform and so much more. This course will examine the origin, and process for getting an initiative on the ballot. The course will also debate whether ballot initiatives are a healthy part of democracy or a way for special interests to bypass the check of the legislature. Students will be required to study and present the pros and cons of a particular proposed ballot initiative, explain why they support or oppose it, how they would rewrite it and finally how they would advocate or narrate their position. Their final project will include an FAQ (frequently asked question) about their ballot initiative. This course is for 1L students only.
