LAW-8046 Trial Practice: Administrative Law/Workers' Compensation

This course is designed as a highly interactive experiential learning course focused on developing written and oral advocacy skills in the civil litigation and administrative law context. The course will feature an introductory overview of the workers’ compensation system and use realistic fact patterns as the basis for classroom discussions and exercises. The course will develop practical skills and build an appreciation for the relationship between substantive law and litigation tactics. Students will orally present their claims and defenses at a bench conference, prepare written motions to join claims/parties, participate in a pre-hearing conference to outline the issues for hearing, participate in a mock evidentiary hearing, conduct direct and cross examinations, and prepare written closing arguments.The course will require meaningful class participation, which will count toward students’ final grades. Grading will be based on oral advocacy skills, written assignments, and class participation. Students will receive substantial feedback through in-class verbal critiques and written comments.
