Related MnSCU Board Procedure: Procedure 1B.0.1 Reasonable Accommodations in Employment
Purpose: The purpose of this procedure is to set forth the process for responding to requests for reasonable accommodations during the search/hiring process based on an applicant’s disability. The college encourages the employment of qualified individuals, including qualified individuals with disabilities. The scope of this procedure is limited to reasonable accommodations and is not intended to fully address other provisions of the Americans with Disabilities Act (ADA) or the Minnesota Human Rights Act.
Part 1: Initial communication with job applicants regarding job vacancies, including job postings, shall indicate the willingness of the college to make reasonable accommodations to the known physical or mental disabilities of applicants, and shall invite applicants to contact the college to request accommodations
Part 2: Individuals who are certified under the State of Minnesota’s Connect 700 program will utilize the initial process of registering and contacting the college’s Human Resources department directly pursuant to their established process under Minn. Stat. 43A.15. Such applicants are not within the scope of this procedure
Part 3: The individual contacted with the request, or a representative from Human Resources, shall immediately contact the Affirmative Action Officer. Requests shall be processed in a timely manner.
Subpart A: T: The Affirmative Action Officer shall contact the job applicant to discuss the requested accommodation and possible alternatives, providing the requesting individual with a copy of Minnesota State Board Policy 1B.4.
Subpart B: If the Affirmative Action Officer approves the requested accommodation, the request will be forwarded to the college president (or designee) for final approval.
Subpart C: If the accommodation is approved, the Affirmative Action Officer and the search advisory committee chair will take the necessary steps to ensure the accommodation is provided.
Subpart D: If the requested accommodation is denied, the job applicant may file an appeal with the college President. If the individual believes the decision is based on discriminatory reasons, they may file a complaint at any time through the discrimination complaint procedure as outlined in the Affirmative Action plan.
